EXPRESS SHIPPING

We will ship using the fastest method available. Some products are described as available from supplier. These products will usually take at least three weeks to arrive from time of purchase. Other products should arrive with buyers within 2 – 5 business days.

SHIPPING RETURNS AND REFUNDS

It is the buyer’s responsibility to return any items at his or her cost. Refunds or replacements will be considered on a case by case basis, in accordance with the relevant legislation.

 PRICES

The prices for the products on the website are stated and are payable in New Zealand dollars (NZD).

GST AND OTHER CHARGES

All prices and delivery charges within New Zealand are inclusive of New Zealand Goods and Services Tax at the rate of 15%, unless otherwise specified.

GIFT VOUCHERS

Gift vouchers will not be exchanged for cash and are not subject to returns for credit or refunds. Appleby Games will not replace a gift card that is lost or stolen after being received. Gift vouchers cannot be used to buy more gift vouchers.

OVERSEAS ORDERS

Except for New Zealand Goods and Services Tax, prices do not include import fees, duties, tariffs, taxes or other imposts or charges which may be payable in relation to the buyer’s order. The buyer shall be liable to pay any import fees, duties, taxes, and other imposts or charges which are payable in relation to buyers order.

Where the buyer and Appleby Games agree to a variation in the quantity of the goods, the goods shall be priced either at the rate applicable to the original quantity or the revised quantity at the absolute discretion of Appleby Games.

Appleby Games may vary any prices on this website at any time and without notice to the buyer.

PRODUCT AVAILABILITY

All orders are subject to the availability of products. If for any reason a product is not available, Appleby Games will endeavour to notify the non-availability on this website. Appleby Games may revise the range of products or the specifications of any product at any time, without notice to the buyer.

CANCELLATION OF ORDER

Where products are listed on this website with an incorrect price or with incorrect information, Appleby Games reserves the right to cancel the buyers order (regardless of whether the buyer has made payment for that order). Where the buyer has already made payment for an order that is subsequently cancelled by Appleby Games, Appleby Games will refund the amount paid by the buyer in relation to that order.

The buyer may cancel their order any time prior to dispatch, such variation, waiver or cancellation of the buyer’s order shall have no effect unless accepted in writing by Appleby Games prior to dispatch.

CONSUMER GUARANTEES

The Consumer Guarantees Act 1993, Fair Trading Act 1986 and other statutes may imply warranties or conditions or impose obligations upon Appleby Games which cannot by law be excluded or modified.  In respect of any such implied warranties, conditions or terms imposed on Appleby Games’s liability shall only apply to the minimum extent required by the relevant statute.

RISK, DAMAGE, LOSS, FORCE MAJEURE

Once the buyers order has been delivered to the buyer (or has otherwise been delivered in accordance with the buyer’s delivery instructions), the buyer assumes full responsibility for and risk in the products.

Appleby Games shall not be liable to the buyer for any loss or damage, directly or indirectly arising out of or in connection with any delay in delivery of the goods, or failure to perform any term of this contract where such delay or failure is outside the Appleby Games reasonable control.

LIMITATION OF LIABILITY

Appleby Games will not be liable for any losses of any kind or any delay in supplying the goods which are caused in whole or in part by circumstances beyond its reasonable control.  This limitation of liability includes, but is not limited to, costs, indirect or consequential loss, loss of contracts, loss of profits and damages caused by or arising from delays in manufacture or delivery of the goods.

Should any liability arise for Appleby Games, such liability shall be limited to the value of the goods supplied.
